Abstract

This paper assesses the significance and impact of the Criminal Justice Act 1993 and the Money Laundering Regulations in the context of previous legislation and examines the extent to which the law has been strengthened by the new legislation. It also highlights the major international initiatives which have been responsible for exposing the extent of the money‐laundering phenomenon and which have helped shape the present legislative framework. The banking and financial system is finding itself in the front line of the war being waged internationally against money launderers. Traditional concepts of banking secrecy are being undermined as governments struggle to preserve the integrity of the banking system. The war is on a vast scale. The Financial Action Task Force (created in 1989 by the seven major industrial nations and the President of the European Commission) estimated that the amount of money being laundered through the financial system was US$85bn per year. The extent of the problem was recognised in the International Narcotics Control Strategy Report for 1993 which found that eight of the world's major money‐Iaundering states are located in Europe. Europe has responded to the growing crisis in the financial sector with the Money Laundering Directive which was due to be fully implemented across the Community by 1st January, 1993. The directive, which applies to credit institutions and financial institutions, including Community‐based branches of non‐Community institutions, reflects a number of key international initiatives and attempts to harmonise the anti‐laundering legislation of the Member States, though with varied success. This paper outlines the directive and its antecedents, before tracing the considerable developments within the UK since the Drug Trafficking Offences Act 1986, which marked the beginning of the Government's campaign to deprive criminals of the fruits of their crime, culminating in the Criminal Justice Act 1993 (CJA 1993). The secondary legislation is also analysed, in the form of the Money Laundering Regulations (the ‘Regulations’), which came into effect on 1st April, 1994. The CJA 1993 introduces and defines the ambit of the new money‐laundering offences, whilst the Regulations clarify the procedures which must be adopted by anyone carrying on ‘relevant financial business’. For the sake of brevity the focus has been only on the position in England and Wales, since Scotland and Northern Ireland are governed by different statutes.

Abstract

Purpose – This chapter offers a unique examination of the influence of a city’s electoral arrangements and political culture on the governing capacity of minority mayors. Highlighting the important roles played by institutional context in shaping the agendas and opportunities for minority mayors enriches the scholarly discussion of descriptive representation.Approach – I employ case study examinations of the three minority mayors elected from the city of Denver, Colorado, focusing prominently on current mayor Michael B. Hancock. I utilize archival data consisting of accounts from local newspaper stories, journal articles, and written recollections from the mayors themselves to evaluate how well three distinct electoral strategies—including a novel strategy, which I have termed as the issue agreement coalition model—aid mayors in advancing the interests of their shared race constituencies. I evaluate these strategies by assessing relevant policy outcomes and economic indicators.Findings – Observational comparisons lead me to conclude that across a variety of issue domains, the issue agreement coalition model provides minority mayors with the greatest capacity to advance their shared race constituencies’ interests, whereas the deracialization model provides the least.Value – This chapter is of value to students of urban politics, particularly those interested in descriptive representation. The novel electoral strategy introduced here provides scholars with a new paradigm allowing for richer evaluations of minority mayoral tenures. Additionally, the focus on the relationship between institutional context and mayoral governing capacity can aid scholars’ understanding of the unique opportunities and limitations facing minority mayors.

Abstract

As a sustainability initiative with the backing of civil society, business, or government interests, urban agriculture can drive green gentrification even when advocates of these initiatives have good intentions and are aware of their exclusionary potential for urban farmers and residents. I investigate this more general pattern with the case of how urban agriculture became used for green gentrification in Denver, Colorado. This is a city with many urban farmers that gained access to land after the Great Recession but faced the contradiction of being a force for displacement and at risk of displacement as the city adopted new sustainability and food system goals, the housing market recovered, and green gentrification spread. I argue that to understand this outcome, it is necessary to explain how political economy and cultural forces create neighborhood disinvestment and economic marginalization and compel the entrance of urban agriculture initiatives due to their low-profit mode of production and potential economic, environmental, and social benefits. Central to how urban agriculture initiatives contribute to green gentrification is the process of revalorization, which is how green growth machines repurpose such initiatives by drawing on their cultural cachet to exploit rent gaps. I conclude with a set of hypotheses to help other scholars test the conditions under which urban agriculture is more or less likely to contribute to green gentrification. Doing so may help nuance convictions about the benefits of urban agriculture within the context of entrenched inequalities in rapidly changing cities.

This essay explores the reactions within police departments toward sexual harassment scandals. The study describes and analyzes reported cases of sexual harassment and misconduct in police departments to discern citizen narratives and political consequences for elected officials. This assessment hypothesizes that political leadership is an essential element in establishing organizational cultures that combat sexual harassment in local governments. The article contributes to the knowledge about possible gaps in agenda setting, especially for a policy area in which knowledge and problem definitions continue to evolve.

LOOKING BEFORE AND AFTER : BEFORE Opening, as we do, a new volume of THE LIBRARY WORLD, especially as with it we reach the venerable age of sixty‐one, does suggest retrospective and prospective view. The magazine is the oldest amongst independent library journals, though others existed before 1899 in different forms or under other titles than those by which they are known to‐day. When at the end of last century it was felt that utterances were needed about libraries, unfettered by uncritical allegiance to associations or coteries, librarianship was a vessel riding upon an official sea of complacency so far as its main organisation was concerned. It was in the first tide, so far as public libraries were concerned, of Carnegie gifts of buildings, not yet however at the full flood. The captains were men of the beginnings of the library voyage; who were still guided themselves by the methods and modes of the men who believed in libraries, yet feared what the public might do in its use of them. Hence the indicator, meant to show, as its name implies, what books were available, but even more to secure them from theft, and to preserve men and women from the violent mental reactions they would suffer from close contact with large numbers of books. There were rebels of course. Six years earlier James Duff Brown has turned his anvil shaped building in Clerkenwell into a safeguarded open access library in which he actually allowed people, properly vetted, to enter and handle their own property. This act of faith was a great one, because within a mile or so some 5,000 books had been lost from the Bishopgate Institute Library, which has open shelves, too, not “safeguarded”. Brown's “cave of library chaos” as a well‐known Chairman, who by one visit was convinced of its good sense and practicability, called it, focused the attention of scores of librarians—so much so that Brown had to beg them to keep away for about a year, so that the method might be better judged after sufficient trial. It also focused the attention of the inventors of the indicator, who, presumably, had more than a benevolent interest in its sales. So there was war against this threat and for several years this childish contention raged at conferences, in private conversations amongst library workers, and in letters to the press aimed to convict Brown and all his satellites of encouraging dishonesty, mental confusion and other maladies public. Hence Brown, L. Stanley Jast, William Fortune and others initiated this journal to teach librarians and library committees how libraries were to be run. That, in extreme brevity, is our genesis. For sixty years it has encouraged voices, new and old, orthodox or unorthodox, who had something to say, or could give a new face to old things, to use its pages. Brown was its first honorary Editor, and with some assistance in the later stages remained so for the thirteen years he had yet to live. Nearly every librarian of distinction in his day has at some time or other contributed to these pages. So much of our past may be said and we hope will be allowed.

Abstract

A strong indication of the reasons behind minority mayors' shift from deracialization can be found in the changes in the U.S. population over the last two decades. The changes in population has eroded – or potentially is in the process of eroding – a key variable in the election of minority mayors: the presence of a majority Black population. For example, with cities losing Black population while gaining Whites and Latinos, the conditions under which Black candidates run for mayor in many U.S. cities are quite different from the experience of the first elected Black mayors. Washington, DC has lost 16% of its Black population since 1990. Between 2000 and 2010, the Black population decreased by 6%. Yet, during the same time period, the district has experienced increases in White population, with a 14% increase since 2000. With a Black population of less than 50% as compared to a Black population over 70% in 1980, the district has enjoyed the distinction of no longer being a majority-Black city (Washington Post, 2007). Atlanta, Georgia also has experienced a loss of Black population (Cox News Service, 2007). These data are suggestive of trends where, if they continue, ambitious Black candidates for mayor will find their electoral coalitions composed of increased numbers of Whites and Latinos in areas where Blacks have dominated for decades.

Abstract

This chapter examines the involvement of finance companies in the purchasing and leasing of Australian farmlands. This is a new global phenomenon as, in past decades, finance companies have lent money to farmers, but have rarely sought to purchase land themselves. We investigate and discuss the activities of the Hancock company – an asset management firm that invested in farmland in northern NSW. Material on the activities of Hancock and other investment firms were obtained from documents on the public record, including newspaper reports. Semi-structured interviews with community members were conducted in the region of NSW where Hancock operated. Australian agriculture is being targeted for investment by companies in the finance industry – as part of a growing ‘financialization’ of farming. While it is financially beneficial for companies to invest, they do not do so in ‘empty spaces’ but in locations where people desire to live in a healthy environment. The Hancock company was criticized by community residents for failing to recognize the concerns of local people in pursuing its farming activities. To date, there have been few studies on the financialization of farming in Australia. By investigating the operations of the Hancock company we identify a number of concerns emerging, at the community level, about an overseas company running Australian-based farms.

Abstract

Purpose

This study aims to use cognitive appraisal theory to explain how organizational disruption influences the development of envy resulting in unethical selling practices, turnover intentions and a reduction in customer orientation that causes disruption to impact customer relationships. This research helps to address drivers of salesperson envy, the potential disruptions to customer relationships and the required need to invest in psychological resources to offset these negative effects.

Design/methodology/approach

A total of 211 salespeople were surveyed to test the hypotheses. First, the measurement model was validated using a confirmatory factor analysis. Next, the hypotheses were tested using structural equation modeling AMOS 27. Mediation and moderated mediation were tested using the bootstrap method. Estimands were created within AMOS to test the indirect and interaction effects in the full model. A post hoc analysis further informed the findings.

Findings

The results show that the development of envy increases under conditions of organizational disruptions, leading to potential customer disruptions through turnover intentions, unethical selling behaviors and a reduction in customer orientation. In addition, the mediation analysis shows that envy drives the relationship between organizational disruption and unethical selling, turnover intentions and customer orientation through fully mediated relationships. Finally, the interaction effects between organizational disruption and psychological capital show high levels of psychological capital help to decrease the development of envy, thus reducing unethical selling behaviors and turnover intentions while increasing customer orientation.

Practical implications

The study provides practitioners with insights into how to reduce envy by investing in the psychological capital of their salesforce. The study also provides suggestions for handling disruptions and managing envy to prevent actions that act to damage customer relationships.

Originality/value

Salespeople are likely to encounter organizational disruption. Sales managers need to be prepared to manage the outcomes of organizational disruption as it impacts the sales force. Understanding how disruptions impact customer relationships through envy is an important yet under-explored topic. This research adds to and expands the sales literature using cognitive appraisal theory to help address drivers of salesperson envy and its potentially negative impact on customer relationships and shows the required need to invest in psychological resources to offset these negative effects. The study also helps expand the recent focus on worldwide disruptions by adopting another context for disruption stemming from organizational disruption.
